This work focuses on the issue of judicial independence and the Court of Justice’s assessment of the recent reforms in the Polish judicial system that undermine the ability of courts to provide effective judicial protection. In particular, the paper analyzes the Court of Justice’s ruling in the context of an infringement procedure launched by the European Commission in case C-204/21, which condemns the application of the new provisions on the organization of courts in Poland.
