This paper analyzes the judgement of the ECJ, WertInvest Hotelbetriebs, in the context of an preliminary ruling launched by Verwaltungsgericht Wien (Administrative Court, Vienna) that concerns the interpretation of Directive 2011/92/EU of the European Parliament and of the Council of 13 December 2011 on the assessment of the effects of certain public and private projects on the environment, with regard to an urban redevelopment project located in a Unesco World Heritage site, and the impact in terms of effective protection.
