The essay analyzes the crisis of democracy starting from neoliberal ideological influences. The notion of “economic constitution” allows us to highlight how neoliberal economic theory has influenced constitutional science and public law. Through the conceptual-historical analysis of “economic constitution,” it highlights how the last few decades have marked a shift from an “inflationary economic constitution,” which defined the face of postwar constitutional democracy, to a “neoliberal economic constitution.” Through the theoretical work of Friedrich A. Hayek we see how the notion of the “constitution of liberty” defines the characters of the neoliberal framework and its relationship to law.
