This paper examines the role of the insurance arbitration body, the effects of its activity on the functioning of the relevant market, and the behavioural incentives generated for the parties required to participate in this alternative dispute resolution mechanism. To this end, it analyses the conditions governing access to the arbitral procedure for insured parties and other beneficiaries of insurance coverage and, in a systematic order, considers the institutional design of the scheme, the support functions performed by the technical secretariat in relation to the adjudicatory panel, and the range of decisions that may be adopted at the conclusion of the proceedings.
