In view of a reform copyright law in Europe the role of the libraries is crucial. Libraries today are in a critical transition phase of the global and local economies, policies and laws are socially controversial because are limiting the traditional library services when moved in the digital environment. Digital lending or access to digital collections are conditioned by several barriers imposed by economical market. The creation of digital libraries throught the large-scale digitisation and making available of Europe's cultural heritage contained in the library collections are actions subjected to heavy moral and economical rights. Indeed publicly accessible cultural institutions should be in the public interest as well as in the interest of the cultural and creative sector because are fundamental issues for a scientific progress of science. Some issues are today perceived as priority key for a debate focused on the social role of the libraries in the science to follow the challenges that the regulation of technological innovations can be conformed in the society. The libraries are embedded inside emerging issues concerning the freedom of scientific research. Consequently the Open access, open data and open educational resources are intellectual and political areas of international discussion.
