This paper, after reviewing the constitutional jurisprudence on the ineligibility and incompatibility of regional councillors, examines the arguments advanced by the Court in the recent judgment No. 131 of 2025. The Court ruled on the unconstitutionality of a law enacted by the Region of Puglia, which significantly brought forward the deadline for removing causes of ineligibility for mayors within the Region, irrespective of the demographic size of the relevant municipality. The decision in question then paves the way for a broader critical reflection on the scope available to Regions for regulating cases of ineligibility.
