The right of resistance, distinct from revolution, is a classic legal concept. It recogni- zes, under certain conditions and with a restorative function, the legitimacy of pe- ople’s disobedience to the commands of institutional powers. The essay traces the nature and essential history of the concept. It also analyses the debate in the Consti- tuent Assembly and the link between resistance as legal concept and Resistance as historical fact. It finally argues the relevance of the right-duty to resist in the context of constitutional democracy.
