La Cassazione stabilisce che le prestazioni economiche e patrimoniali effettuate da un convivente nei confronti dell’altro dopo la cessazione della convivenza sono fondate sui vincoli di solidarietà ed affettività originati nella convivenza stessa e pertanto, ove sussistano tutti i presupposti di cui all’art. 2034 cod. civ., trova applicazione la regola della soluti retentio. The Supreme Court establishes that the economic and patrimonial benefits made by a cohabitant towards the other after the termination of the cohabitation are based on the bonds of solidarity and affectivity originating in the cohabitation itself and therefore, where all the conditions referred to in art. 2034 of the Civil Code, the rule of soluti retentio applies.
