Lo Stato regolatore e i suoi limiti a fronte del cyber risk

In acknowledging the indispensability of technological progress and the critical issues connected to it, the paper considers IT risk and the type of attention dedicated to it by the regulation. Secondly, it considers the different levels on which public prevention and containment action can develop, identifying some objective limits which, due to their characteristics, appear dif!cult to overcome. Subsequently, it indicates how even some non-speci!c rules can contribute to the limitation or containment of the dangers deriving from the unstoppable digital transition even if not designed to satisfy this purpose.
