The work analyses the Italian legislation governing the electronic health record (EHR). Among the other things, it dedicates particular attention to the role of this tool in the context of the Italian healthcare digitalisation; the paper also deals with the problems related to the elimination of the data subject’s consent for the implementation of the EHR and it tries to highlight some possible actions for the enhancement of this tool expressly provided by the Italian National Recovery and Resilience Plan (NRRP).
