The essay offers a critical analysis of the concept of “transnational solidarity”, linking it in particular to the issue of migrant citizens’ rights in the light of the case law of the Court of Justice of the European Union on the concept of worker and the exercise of freedom of movement. The difficulties in conceptualising the principle of solidarity in EU law are first investigated in the context of the persisting uncertainty about the nature of the overall legal order, and then read in the magmatic evolution of the jurisprudence that has slowly “constructed” the rights connected to European citizenship.
