The article aims to investigate both the doctrinal debate on the asymmetric regionalism and some of the issues that have emerged so far in the debate on the so-called “draft agreements”. The aim of the paper is to offer, firstly, some useful tools to situate the problem of the delimitation of matters within the framework of the constitutional principles; secondly, to argue the opportunity of configuring the limits to differentiation not “in the abstract”, but concretely in the light of the case-law by the Constitutional Court which, in relation to matters of concurrent legislation, has often distinguished between unitary demands and local interests.

Abstract

The article aims to investigate both the doctrinal debate on the asymmetric regionalism and some of the issues that have emerged so far in the debate on the so-called “draft agreements”. The aim of the paper is to offer, firstly, some useful tools to situate the problem of the delimitation of matters within the framework of the constitutional principles; secondly, to argue the opportunity of configuring the limits to differentiation not “in the abstract”, but concretely in the light of the case-law by the Constitutional Court which, in relation to matters of concurrent legislation, has often distinguished between unitary demands and local interests.
