This essay deals with the bribery of 'iudices privati' from the decemviral era until the end of the classical age, denying a connection with the 'litem suam facere' (even in the later type, described by Ulp. 21[23] 'ad ed.' D. 5.1.15.1) and discussing the conceivable application of 'crimen repetundarum' to those who were charged with the 'officium iudicis' in the procedure 'per formulas' and at the dawn of 'cognitio extra ordinem'. From the review of these topics arises a rich dialogue with Carlo Venturini, whose studies are an essential cornerstone when faced with criminalistic profiles of judicial misconduct.
