The Report of the ILO’s Global Commission, ‛Work for a Brighter Future’, makes no explicit reference to inmates’ labour and its regulation.However, this issue is relevant in light of the ILO Centenary Declaration on the Future of Work, adopted in Geneva on 21 June 2019. The declaration strongly insists on strengthening the capacity of all to benefit from the possibilities offered ‛par un monde du travail en mutation’ through, in particular, effective measures to accompany people through the transitions ‛elles auront à faire face tout au long de leur vie professionnelle’ (Article III.A.iv). In Article III, the declaration leads us to reflect on the enhancement of ‛skills’ to ensure equal opportunities and treatment in employment not only for people with disabilities, but also for people in vulnerable situations (Article II.A.viii). First, the essay investigates about the concepts of ‛vulnerability’ and ‛poverty’ to verify in which terms detention assumes importance from the perspective of the centenary declaration. Second, it aims to verify whether and to what extent the recent reform of the Italian prison system (Legislative Decree no. 123 of 2018) has effectively intervened in ‛rehabilitation’ in terms of the ‛capacity’ of detained persons.
