The article provides a theoretical account for the ever growing practice of national and supra-national courts of using foreign precedents to justify a decision. The theoretical framework is based upon the Legal Reasoning perspective, thighting the joint between the argumentative turn and the reprise of the classical Rhetorical tradition in order to trace the limits of legitacy of that judicial practice.
